13th Circuit Court Judge Thomas Power gave a woman an extra-long prison sentence because she was pregnant. Because obvy he knew better than the laws and the constitution and we just don’t need those when we have Judge Power.
The Michigan Court of Appeals rightfully overturned the sentence, but not before the woman had served most of it. They sent the case back to the other circuit court judge, Judge Elsenheimer, for resentencing.
Elsenheimer decided not to do what the 13th Circuit Court has done so many times in the Schwander case, and that’s to double down and add some sarcasm. Instead, Elsenheimer sentenced the woman to time served and waived some fines and costs that are often waived for indigent defendants.
